ICC Ruling On Kenyan Case. Let Justice Take Its Course.
ICC finally rules on the Ocampo Six.
The International Criminal Court (ICC) said on Monday it would try Kenya’s presidential contenders William Ruto and Uhuru Kenyatta and francis Muthaura and Joshua Sang on charges of crimes against humanity during post-election violence in 2007/08.
Let justice take its course.
The Hague-based court said there was sufficient evidence to put Kenyan radio presenter Joshua arap Sang and Kenyan civil service head Francis Muthaura on trial, but the court dropped charges against Henry
Kosgey and General Mohamed Hussein Ali, who was the police commissioner when the violence erupted.
This means the four will face the full force of the law for war crimes linked to Kenya’s 2007/08 post-election deadly was of political violence violence that claimed at least 1,500 people and displaced hundreds of thousands, marking the darkest moment in Kenyan history.
But sources said the four may appeal the decision in the appeals chamber, another process that might take several months.
It was not clear of the Kenyatta and Ruto will keep their word of vying for the Kenyan presidency, but analysts said it was unlikely for them to throw their hats into the race to replace President Mwai Kibaki and would unwise if they do so.
The following are reactions to the decision.
KEN WAFULA, HUMAN RIGHTS ACTIVIST IN KENYA
“This ruling changes the political landscape of this country. Kenyans will now be able to go to the polls without fearing violence. I think it was fair, and I think some of us will work through the procesuction process to ensure further evidence is given.”
On charges being dropped against former police commissioner Mohamed Hussein Ali:
“I am disappointed because so many Kenyans were killed by the police and I didn’t expect Ali to escape prosecution, being that Ali was the representative of the police. We may want to push the prosecution to review the case against Ali.”
ALY KHAN SATCHU, INDEPENDENT ANALYST
“The crux of the matter is the reaction to the decision not the decision, which was expected. We are witnessing an inflection point lower in Kenya political risk. This is a tipping point. Kenyan markets have all the bad news baked into the price and none of the positive.” (Jackal News and news agencies)

Focus On Tribalism In Kenya Jobs.
Employment News making headlines in Kenya.
Mohammed kuti has appointed Ibrahim Haji as Kenya Meat Commission managing director.
Finance Minister Uhuru Kenyatta has appointed John Njiraini as the new Kenya Revenue Authority (KRA) Commissioner General.
Following these two events, online commentators have judged both appointments as tribalistic. One tribesman looking after another. Personally i believe the two gentlemen are qualified and can deliver. But delivering is one thing and managing public expectations is another. I think the online commentators are justified in thinking in that direction.
The fact is Kenyan ministers are fond of appointing their tribesmen and friends to top positions.
The National Integration and Cohesion Commission themselves had exposed this rot in their April audit on ethnic profiling in the Kenyan civil service.
That research revealed that the big five — Kikuyu, Kalenjin, Luhya, Kamba and Luo — occupy 70 per cent of positions in the civil service, while 20 ethnic communities hold less than one per cent.
Statistics do not lie. Besides, having your own man in State House is a huge advantage, confirmed by the fact that Kalenjins hold 16.7 per cent of all civil service posts despite accounting for only 13 per cent of the population.
Yet, statistics can conceal important details. It would appear upon further scrutiny of these figures that cronyism and nepotism are even greater problems than ethnicity.
A closer look at the composition of all the top posts would show that loyalty, cronyism and blood ties were the determining factors in allocating most top positions.
The Kikuyu top jobs are not widely distributed among their community, nor indeed are the Luo jobs well dispersed among the Nyanza population.
Previous audits on the composition of 51 Kenyan envoys showed how loyalty and family were rewarded equally by both principals.
Their appointments give a whole new meaning to power sharing. Both parties are equally adept at planting their cronies and family members as ambassadors.
A closer examination also of not just the Prime Minister’s office, but every other of the 40-something ministers in this bloated cabinet would reveal that in the absence of any opposition or oversight body, every minister has put his family and buddies in top jobs.
If you doubt the extent of the problem, have a look at any Kenya Gazette of the past couple of years and get an informed view of appointments to parastatal boards, university governing councils or any one of hundreds of committees.
You will see that cousins, failed politicians and disgraced administrators reappear in obscure committees and collect hefty sitting allowances as they decide on weighty matters for which they have no aptitude or experience.
This coalition grudgingly agreed to sit quietly and eat together in February 2008. The two elite groups are the real beneficiaries, not the communities from where they originate.
The big issue in Kenya is not tribalism but elitism, cronyism, nepotism and insatiable greed.
It saddens me to see that tribalism is still deeply entrenched in our society be it in the public or private sector. Does your company practice tribalism?
